The Greek court has rejected the application for interim measures submitted by AEPI (Greek Society for the Protection of Intellectual Property), requiring providers to block access to torrent files.
According to the court decision as it publishes it void.gr, το δικαστήριο έκρινε ότι το αίτημα της ΑΕΠΙ παραβιάζει την αρχή της αναλογικότητας, είναι δηλαδή υπερβολικό μέτρο.Επιπλέον, με τα μέτρα που ζητούσε η ΑΕΠΙ θα καταστέλλονταν «όχι μόνο παράνομες αλλά και νόμιμες πράξεις», δεδομένου ότι η τεχνολογία tοrrent επιτρέπει την ανταλλαγή όχι μόνο πειρατικών ταινιών και μουσικής αλλά και νόμιμων αρχείων.Τα αιτούμενα μέτρα κρίθηκε έτσι ότι παραβιάζουν την ελευθερία της πληροφόρησης, το δικαίωμα συμμετοχής στην κοινωνία της informations and the privacy of communication. Furthermore, the court notes that the requested measures do not meet the "criterion of appropriateness" because they simply would not be effective: the services torrent sites that were on the "black list" of AEPI, like the popular one Pirate Bay, now operate at different Internet addresses (IPs) and would remain accessible to users.
Furthermore, AEPI's request has been found to violate the EU Charter of Fundamental Rights. In particular, it violates the right of providers to entrepreneurship, as well as the principle of online neutrality, which provides that all information must be non-discriminatory.
The court, lastly, commented that infringed copyright "is less and less relevant to the creators themselves and more to the interests of the companies of the cultural industry themselves"
