Robert Saiger says he has accepted the upgrade, but claims to have lost data, "time and money, and everything was getting worse when he tried to recover his data."
Howard Goldberg also approved the upgrade but said the "computer was damaged" as Windows 10 was not installed properly. Goldberg paid someone to repair his computer because it was out of warranty and he claims his lost data, time and money, but also his own computer.
The complaint claims Windows 10 is a consumer product under US law and accuses Microsoft of being aware that the upgrade could cause data loss and hardware damage.
