Passed FISA Section 702

The US Congress failed to pass an amendment that would have banned warrantless surveillance of Americans. The amendment proposed by Andy Biggs failed to pass on a vote sections 212-212.

This means that US citizens who are in communication with foreigners the government is monitoring will continue to be monitored without a warrant.

Section 702 of the Alien Surveillance Act has been controversial for its provisions that indirectly allow surveillance of US citizens without a warrant. That was also the reason why a group of Republicans in cooperation with some Democrats tried to block the vote in the House.

The point was that FISA Section 702 technically authorizes the US to spy on aliens abroad who are considered a threat, but if those aliens communicate with US citizens, then those citizens' electronic communications could also be used to gather information.

Republicans, along with Democrats, have called for an amendment to the reauthorization bill to require a warrant before collecting data belonging to Americans. The amendment proposed on Friday in the morning, but it did not pass.

The full bill to reauthorize the surveillance — rushed through the House to avoid being repealed on April 19 — passed the House with bipartisan support, despite calls to end warrantless surveillance. The Senate must now pass the bill before the April 19 deadline, giving the chamber all of this week to do so.
