Privacy protection is now taking it to another level, as court decisions recognize monetary compensation for moral damage, starting at 10.000 euros, without criminal involvement and without legal risk for the citizen. The responsibility lies exclusively with the companies and call centers that violate the law.

The legal shield of subscribers

A key role in this development is played by the so-called "Register 11", which is provided for by article 11 of law 3471/2006. This is a mandatory list maintained by every telecommunications provider and in which subscribers who declare that they do not wish to receive any advertising or promotional telephone communication, regardless of company or purpose, are registered.

From the moment a citizen registers in "Register 11", his declaration has universal validity. No individual requests to companies, nor additional actions are required. Any subsequent call is automatically considered illegal and establishes the right to compensation.

How to register

The procedure is purely civil and is directed exclusively against the offending company. The citizen is not involved in criminal proceedings, nor does he assume any costs or risks. On the contrary, the case law fully transfers the burden of compliance to the businesses, which are obliged to cross-check their data with “Register 11” before each campaign.
