The lawyer of journalist Thanasis Koukakis, Zacharias Kesses, with a publication announced on social media his client's appeal to the European Court of Human Rights regarding his double surveillance by the EYP and the Predator.
“The appeal of journalist Thanasis Koukakis against Greece for his double surveillance by the EYP and through Predator was filed yesterday at the European Court of Human Rights.
At the core of the appeal lies the refusal of the national authorities to investigate the case independently, impartially and effectively.
The issue of objective impartiality is particularly critical, as the then Supreme Court Prosecutor Konstantinos Tzavellas handled the relevant case file, even though he himself had signed the provisions lifting Koukakis' confidentiality in 2020, without abstaining or recusing himself.
The application alleges violations of Article 6 §1 ECHR regarding objective impartiality, Article 8 regarding the protection of private life and communications, Article 10 regarding freedom of journalistic investigation and protection of sources, as well as Article 13 in conjunction with Articles 8 and 10 due to the lack of an effective domestic remedy.
There is no room for any concession or retreat when it comes to issues of the rule of law, the independence of the judiciary, and the protection of fundamental rights. A cover-up, no matter how institutionally framed, does not become justice.
