Although it is pretty clear that all the problems are caused by the firmware update and not by the devices themselves, it seems Microsoft agrees to replace the tablets that run the new firmware !!!.

Report a user in the Microsoft forum:
"Hey friends .. and that's how I met her of Surface via chat... They agreed to send me a NEW Surface in replacement. I took care to make sure that the replacement wouldn't just be a rebuild
Their eI explained the issue with the firmware and that I had already done everything to deal with it… as well as my concern about overheating ”

And immediately below a second user confirms: “I also did the same and sent the Pro 2 for exchange. "Hopefully they will send me a new tablet and not repair mine."

Microsoft has not provided more information about the new firmware upgrade, but will likely release a new one this month, as part of its monthly update every Tuesday.
