A group of friends who translated subtitles for pirate bands took legal action against BREIN the anti-piracy group and they were not vindicated by the court. The subtitle translation group Free Subtitles Foundation lost its battle this week in the District Court of Amsterdam which ruled in favor of BREIN on all counts.
It is known that millions of people all over the world are downloading subtitles as they are absolutely for watching popular movies and TV series. 
So the small files of the subtitles are extremely popular on the internet. For this reason various translation teams have been developed that translate the text from another language, or make the translation by listening to the film.
Greece, of course, could not stay behind, just like any country where English is not its mother tongue.
For many years now, these translators seem to be flying under the radar, but they are being put under more pressure by anti-piracy groups around the world. The BREIN team was quite active on this front, forcing several subtitling groups to retreat.
The Free Subtitles Foundation has decided to file a lawsuit against BREIN hoping to become an official subtitling group in the Netherlands if it takes a favorable court decision.
The team's lawyer, Camiel Beijer, told TorrentFreak that the case revolves around two issues.
"The main question is whether the creation and publication of subtitles for films is an act done exclusively by the producer of this film,
The second topic is a review of BREIN's behavior against people who create and reproduce subtitles. The Free Subtitles Foundation hopes that a court ruling will shed more light on these two issues. "
This week, the District Court of Amsterdam issued the decision (PDF) and the news was bad news for the Free Subtitles Foundation. The Court rejected all their allegations and justified BREIN in every case.
The Court ruled that subtitles can only be created and distributed after special permission has been obtained from the copyright holders. Translation of subtitles without permission, recommends infringement Copyright.
"There are many so-called traffic groups that distribute movies and TV series from illegal sources and add illegal subtitles to the Dutch market. "This decision makes it clear once again that this is illegal," said BREIN director Tim Kuik.
"With this decision, it will be easier for BREIN to continue its work against illegal subtitling and against sites and services that distribute illegal subtitles and TV shows from an illegal source," Kuik concludes.
